A federal judge has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without legal authority.
"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her ruling.
The situation stems from a erroneous removal to El Salvador earlier this year, which the government later acknowledged was an mistake. Following his return to the United States to face alien smuggling charges, he was held in immigration detention.
In her decision, the court pointed out that the government lacks a current removal order, which prevents them from removing Mr. Abrego Garcia "at this time."
The legal challenge involve conflicting assertions. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this claim.
He has also pleaded not guilty to the smuggling counts, which are part of a separate trial in the state of Tennessee.
The court, who was hearing his challenge to deportation in a federal court, ruled that he must now comply with the conditions of his release from jail in Tennessee. This decision shifts his supervision to the jurisdiction handling his criminal case.
This ruling represents a significant development in a complicated legal case featuring allegations of wrongful detention and contested gang associations.
