Czech Republic's Populist Prime Minister-Elect Refuses to Divest Corporate Holdings During Ethical Dispute

Andrej Babiš, the self-styled tycoon who secured victory in last month's Czech election, has declined to sell his extensive corporate assets, while asserting he will resolve a conflict of interest that might prevent him from taking the position of prime minister.

Stance on Business Holdings

Babiš, whose political movement came first in the autumn vote but did not secure a majority in parliament, declared in a online statement that he will not divest his Agrofert conglomerate, which operates in agriculture, food production, and chemical industries.

“I have repeatedly said I will never sell Agrofert. I have repeatedly stated I will resolve the conflict of interest in accordance with national and European laws,” Babiš commented. “This is different from selling a roll in a bakeshop.”

Head of State's Demand

The head of state, Petr Pavel, announced that the elderly political figure must publicly explain how he will remove conflicts of interest arising from his corporate dealings before being appointed premier.

The Czech constitution “clearly mandates the head of state to take into account the potential occurrence of a conflict of interest and the ways to address it” when selecting cabinet members, Pavel's office noted.

The president “expects clarity in what precise manner Andrej Babiš will fulfil his statutory duties”, the announcement said, noting that Pavel was ready to designate Babiš as prime minister “immediately” once the matter was settled.

Corporate Activities and Regulatory Concerns

Babiš's numerous firms, mostly under the Agrofert umbrella, function in the nation and other central European states, benefiting from substantial funds in national and EU farming and other grants, as well as public contracts.

Under national legislation, cabinet members are barred from obtaining state support or contracts. The ethics watchdog Transparency International has stated that to avoid a ethical breach, Babiš must either sell, refuse government deals, or not enter public office.

Previous Tenure and Current Intentions

Babiš affirmed he would “abide by the regulations” if selected as premier, but did not want to explain how in beforehand because the matter was “an extremely sensitive and private affair for me, and the media will invariably question me regardless”.

During his first term as premier, from 2017 to 2021, Babiš encountered several legal battles and an European inquiry over possible ethical issues. He placed his assets into trust funds, while keeping certain control over them.

A court and the European Commission both ruled that this did not suffice. Babiš stated recently that he was again the exclusive proprietor of Agrofert and insisted he was “taking steps” to prevent a conflict of interest, but refused to reveal specifics.

Governing Deal and Foreign Policy Implications

The billionaire populist has signed a coalition agreement with two rightwing fringe parties, the ultra-conservative, pro-Russian SPD, which has called for a public vote on leaving the EU, and the Motorists for Themselves, which has primarily campaigned against the EU’s environmental policy.

The new government, if approved, is likely to bolster the populist movement in central and eastern Europe and might strain western support for Ukraine – even though Babiš has contacted Ukraine’s leader, Volodymyr Zelenskyy, to assure him of Czech support.

Pavel, who as head of state has a role for foreign policy, also requested that the coalition’s programme add a declaration on the government’s position on Russia’s war in Ukraine, with a commitment to fulfilling alliance duties.

The president has earlier said he would not approve any ministerial nominees who might doubt the Czech Republic’s EU and Nato commitments, a condition that the far-right SPD has indicated it will satisfy by proposing independent technocrats.
